Terms of Service

1. Acceptance of Terms

By accessing or using backlynk.io ("the Service"), operated by Backlynk ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Backlynk.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the website at least 14 days before taking effect. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.

2. Description of Service

Backlynk provides automated directory submission services for websites. The Service includes, but is not limited to:

  • Submitting website information to web directories on your behalf
  • Automated verification handling during the submission process
  • Email verification and confirmation handling
  • Real-time tracking of submission status and progress
  • Backlink monitoring and health reporting

We do not guarantee that every directory will accept your submission. Acceptance decisions are made solely by each third-party directory.

3. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By creating an account, you represent and warrant that you meet this age requirement. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

4. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate and complete information about yourself and your websites
  • You may only submit websites that you own or have explicit written authorization to manage
  • You are responsible for all activity that occurs under your account
  • You must promptly notify us of any unauthorized access to your account

5. Acceptable Use

You agree not to use the Service to:

  • Submit websites containing illegal, fraudulent, or deceptive content
  • Submit websites hosting malware, phishing pages, or harmful software
  • Submit content that infringes on intellectual property rights of others
  • Submit websites promoting hate speech, violence, or discrimination
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Interfere with the Service's operation, servers, or networks
  • Circumvent usage limits, rate limits, or security measures
  • Create multiple accounts to circumvent plan restrictions
  • Resell or redistribute the Service without written authorization

Violations may result in immediate account suspension or termination without refund, at our sole discretion.

6. Payment and Billing

Plans are billed as one-time purchases per website, unless otherwise stated. All prices are displayed in US Dollars (USD). Payment processing is handled by our authorized payment partners. Charges may appear on your statement under the name of our payment partner.

Card and PayPal payments are eligible for a refund within 7 days if fewer than 10 submissions have been completed. All cryptocurrency payments are final and non-refundable. Full details are in our Refund Policy.

7. Intellectual Property

The Service, including its software, design, features, documentation, brand elements, and all content created by us, is the exclusive property of Backlynk and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during the term of your subscription.

You retain full ownership of any content (website data, descriptions, logos) that you submit through the Service. By submitting content, you grant us a limited license to use it solely for the purpose of providing the Service (i.e., submitting it to directories on your behalf).

8. Service Availability and Modifications

We strive to maintain high uptime but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. If we discontinue a feature material to your use, we will provide reasonable advance notice.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) the results obtained from the Service will be accurate or reliable; or (d) any specific SEO outcomes, search engine rankings, or domain authority increases will be achieved.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKLYNK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

Our total aggregate liability for all claims related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.

11. Indemnification

You agree to indemnify, defend, and hold harmless Backlynk and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit through the Service.

12. Termination

Either party may terminate this agreement at any time. You may close your account through the dashboard settings or by contacting support. We may suspend or terminate your access immediately if you violate these Terms, without prior notice or refund.

Upon termination, your right to use the Service ceases immediately. Your submission data will be retained for 30 days after account deletion to allow for data export, after which it will be permanently deleted.

13. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally within 30 days, either party may pursue formal resolution. You agree to attempt mediation before pursuing litigation.

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIMS WILL BE BROUGHT INDIVIDUALLY AND NOT AS PART OF A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms caused by events beyond our reasonable control, including but not limited to natural disasters, internet outages, third-party service failures, government actions, or cyberattacks.

16. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Disclaimer, and DMCA Policy, constitute the entire agreement between you and Backlynk regarding the use of the Service, and supersede any prior agreements or understandings.
